    For the original of which the following is an assignment see Book of Deeds No 51. Page 112 and Know all men by these presents that I James D Simmons and Lydia Ann his wife of the Town of Sandlake County of Rensselaer and State of New York for and in consideration of the sum of Five Hundred dollars well and truly paid to me by Stephen Ives of the same place the receipt of which is hereby acknowledged do hereby grant bargain sell assign and set over unto the said Stephen Ives(husband of Anna Simmons James' sister.) his heirs administrators and assigns all the pieces or parcels of land described in the annexed indenture except the ten acres described as being the fifth lot which is conveyed to the said James D Simmons in the said Indenture to have to hold the granted premises with all the privileges and appurtenances to the same belonging to him the said Stephen Ives his heirs administrators and assign hereby covenant and agree to and with the said James D Simmons for himself his heirs executors and assigns hereby covenant and agrees to and with the said Stephen Ives his heirs and assigns that the premises are free and clear from all and every encumbrance Except such as mentioned in the original deed to the said James D Simmons to which this assignment is annexed and Except the claim of the widow Catharine Larkins (according to my research this should say Catharine Simmons) that the said James D Simmons his heirs administrators assigns will warrant and forever defend and it is further covenanted between the parties to these presents that the said James D Simmons shall pay the claim to Betsey Simmons of fifty dollars and save the said Ives harmless therefrom and it is also further agreed that the said Ives shall not cut off the premises hereby conveyed any more wood or timber than shall be necessary for him to use for the benefit of the said premises until such times as the said Ives shall pay to the said Simmons all claims which he may hold against the premises herein conveyed and the said Stephen Ives further covenants and agrees to fulfill all and everything mentioned in the deed to which this is annexed which the said James D Simmons is therein bound to do and the said Ives further agrees to save the said James D Simmons harmless from the costs of a suit already commenced by the said Widow Catharine Larkins (Again-this should be Catharine Simmons, William Simmons 1st wife, as she did bring suit to claim her dower rights) against the said Simmons In witness whereof the parties have hereunto set their hands and seals this twenty second day of April in the year 1846

    Rensselaer County Town of Sand Lake on the 22d day of April in the year 1846 came before me James D Simmons, Lydia Ann Simmons wife of the said James and Stephen Ives all of them known to me to be the same present described in and who executed this assignment and severally acknowledged they executed the same for the uses and purposes therein mentioned and the said Lydia Ann on a private examination by me and apart from her said husband acknowledged that she executed the same freely without fear of her husband.

    "Civil Calendar: No. 31, Charles M Davis, Don Carlos Woodcock & Geo. R Davis, Jr. vs Catharine Simmons

    This suit was bro't to recover for attorney and counsel fees taxed by the plaintiffs against the defendant.

    On the 17th day of May 1842 the defendant executed a power of attorney authorizing Charles M Davis to commence certain suits for the defendant to recover her dower in certain lands of which her husband had died seized.

    In pursuance of this authority, several suits were commenced in two of which the defendant (their plaintiff) failed to recover. It is for the costs of these two suits that the plaintiffs, who were partners at that time, bring this action.

    The defense is that Mrs. Simmons, at the time of the execution of the power of attorney, was insane."

    This is her 20 acre portion (of the 100 acres farm) that was given to her by her father, John Cropsey, in 1791.
    This indenture made on the 4th day of December 1848 between Jacob Simmons of the town of Greenfield in the county of Saratoga and state of New York committee of the person and estate of Catharine Simmons a Lunatic of the first part and James A Culver of the town of Berlin in the county of Rensselaer and the state of aforesaid of the second part. Whereas by an order of the Supreme Court of the state of New York in equity made on the thirteenth day of August 1848 reciting among other things that it appeared to the said court that person estate of Catharine Simmons was insufficient for the payments for the debts and that a sale of the real estate of said Lunatic was nicepany for the payment thereof the said Jacob Simmons as such committee among other things authorized emforesaid and directed to sell at public or private sale subject to the approbation of the court the tract of land belonging to the said Lunatic specified therein for the purpose of paying and discharging the debts of the said Lunatic and to report the time of the sale made by him to the court on oath before any contractor deed should be executed. And whereas the said Jacob Simmons as such committee having influence of said order on the fourth day of December 1848 made his report to the court on oath stating that he had entered into an agreement subject to the approbation of the court with James A Culver of the town of Berlin in the county of Rensselaer aforesaid for the sale to him of the said tract of land and for the price or sum of five hundred and eighty six dollars to be paid on the delivery of the deed. Therefor and whereas by another order of the said court dated the fourth day of December 1848 it was among other things ordered that the said report and the said agreement be ratified and confirmed and that the said committee should execute acknowledge and deliver to the said James A Culver a good and sufficient conveyance of the tract of land so purchased by him upon receiving the purchase money agreed to be paid therefor. Now therefor this Indenture witnessth that the said party of the first part committee as aforesaid by virtue of the power and authority conferred upon him by the several orders above mentioned and in pursuance of the statute in such case made and provided for and in consideration of the sum five hundred and eighty six dollars the said purchase money to him paid at or before the ensealing and delivery of these presents by the said party of the second part the receipt whereof is hereby confessed and acknowledged hath granted bargained sold remised released and conveyed and by these presents doth grant bargain sell remise release and convey unto the said party of the second part his heirs and assigns forever all the right title and interest of the said Lunatic of in and to all that certain tract piece and parcel of land aforesaid which is situate lying and being in the town of Berlin in the county of Rensselaer aforesaid and bounded and described as follows on the North by land of Eunice Wheeler on the South by land occupied by John Gunel on the East side by land of John Tars and on the West by land of John Rathbone or Denis Wheeler containing about twenty acres to have and to hold the same and every part thereof with the appurtenences to the said party of the second part his heirs and assigns to his and their only proper use whereof the said party have hereunto set their hands and seals the day and year first above written.
